Immigration and Asylum Appeals
If your immigration application or asylum claim has been wrongly refused, you have the option to file an immigration appeal or request an administrative review of the decision.
An administrative review application to the Home Office can be submitted. This is an application to correct an error that occurred during the decision-making process. In situations where there is no right of appeal against the decision, administrative review is typically available. It is accessible in conjunction with or apart from the right of appeal for applications made under the EU Settlement Scheme.
In certain situations, such as applications made as an adult dependant relative or as the spouse or partner of a British citizen, when the refusal violates your human rights, there is an appeal right. You would generally be given a right of appeal if your asylum claim is refused.
An immigration tribunal, which is separate from the Home Office, hears appeals pertaining to immigration and asylum. An immigration judge hears appeals, and the hearing can take place in person or via video link, with the parties and the judge present. For the appeal, you will typically have bundles of paperwork for both sides as well as witness statements prepared.
