Fiancé and Spouse Visas
At TMF, we have assisted clients in coming to the UK or extending their stay in the UK on the basis of their relationship with their partner or spouse. The relevant rules can be complex, it is therefore advisable to seek legal advice where possible.
Partners/spouses :
- Both you and your partner must be at least eighteen years old to apply
- Your partner should either be a British citizen, have indefinite leave to remain, have pre-settled status under the EU Settlement Scheme, or have humanitarian protection or refugee status
- You and your partner must plan to live together permanently in the UK
- You must submit documentation of being in a legally recognised marriage or civil partnership or prove that you have been living together for at least two years at the time of application or state that you are engaged, to be married or enter a civil partnership within six months of coming to the UK
- You must meet financial requirements either through your partner’s salaried income or income from their self-employment, cash savings, or through pension payments
- To apply, you must also satisfy additional requirements, any previous marriages must be dissolved legally, have a strong command of the English language, and the ability to support yourself and your dependents financially
- If you don’t meet the above requirements, you still have options to apply for entry clearance or your permission to stay in the UK. These options would include if you have a child who is a British citizen or who has lived in the UK for seven years and it wouldn’t be reasonable for them to leave the country; you have a partner and living abroad as a couple would present challenges that you couldn’t overcome as a couple
